I have a '99 and just replaced a rear shock, bump stop and spring spacer. The spring is rubbing quite a bit on the top 1/3 of the coil over sleeve. Top shock nut is tight so I'm not sure what is causing the rub?

Normal movement of the suspension. Unless you decide to Rally the car, you will never use the top 1/3 of the sleeve.

I wouldn't even worry about it. If it bothers you, turn the whole assembly 180* so it wears on a new spot.
Purely cosmetic.

We have the same problem, When comparing RR and LR Springs, we saw that one spring was pretty curved. Poor manufacturing quality from Eibach. This isn't the first time this has happened. We haven't had any failures when keeping it installed.
Just run it.
