less some go away or lets just be done with this money.. say like 100-150k which Tony's insurance company will likely pay not to litigate, Tony is not paying a dime. I think the toxicology report came a surprise to many. That is two solid strikes against him, bad judgement coming on to the track and impaired by marijuana.
My opinion hasn't changed.. Stewart tried to dust him or push him back. Obviously with no intent on hitting him and it all went wrong. With Ward being influenced.. It is game over for the Ward family IMO, most likely it was game over for them Aug 9. I can't even imagine.

Unfortunately I don't think the "substance influence" will dismiss a suit. True story: Drunk driver over twice the legal limit, speeding on ice and snow covered road, hits pothole, loses control, takes out telephone pole and is paralyzed in the process. Lawsuit filed against township, electric company, and every property owner that his car came in contact with during the crash. In the lawsuit, he concedes his "portion" of the responsibility but asserts other contributing factors to which a percentage is assigned. Damages are figured into the millions and claims against defendants are based on their percentage.
I disagree with this argument but settlement money was paid to dismiss. Tony Stewart's agents will likely do something similar.

I can tell you from experience that insurance companies rarely pay money that they feel they do not owe, Yes maybe 5 or 10,000 which they feel is the cost of defending the case, but before they pay big dollars they have to see some risk. that could happen as the case unfolds, if Tony was a bad witness or said some things he should not, So you never know till all the facts are in, but i think its unlikely to go anywhere.
I think some of the Media stories are funny, talking about how NASCAR have changed the rules to make racing safer, requiring drivers to stay in the car unless its on fire or told by an official its OK to exit. What NEW rule are they talking about?

I'm not sure if i'm not crossing the line on this subject, delete it if you want.
For me, I've smoked it and ended up looking at a bowl of fruit on the couch and then cleaning out the frig.
But I know people that do it and race karts and they're fast. Slows the mind but not the reflex, I guess, slow is fast?
From what I've learned with it legal in some place, there's different type that do different things, sleep, relax, awake, whatever.
But I don't think it right to do it before a race.

Even if it had no effect on him, he did it and he will be looked at as "impaired". No changing that. With the facts of the case already leaning heavily in Stewarts favor, this probably puts it completely over the top.
I agree that the facts that we have seen and heard so far lean hard in Tony's direction. Looking beyond that and if the family decides to pursue a civil matter, I think Tony's camp ends up making some kind of settlement to put this to bed. He's got a lot to consider with sponsors and public image and a long drawn out very public mess doesn't benefit him.

My guess is any civil case is dead in the water following the revelation of Mr. Ward's substance abuse. (i.e.: Tony ain't paying a dime to the Ward family)
My thoughts exactly. The fact the grand jury found no compelling facts is huge. The parents statement seems to be just a huge denial of anything found(or not found)to date. Other than a victim of his own circumstance...Kevin Ward is not a victim.
